LO3: (M2) Discuss legal and ethical requirements
As I am creating a website I need to stick to the Copyright and Patents act of 1988 and make sure I adhere to these laws. I will need to make sure I don't have anyone else work on my website which I haven't granted access too, for example logos or website design. This also links in with the Intellectual property Right, this helps the producers work protected from anyone stealing their work. Therefore, I will make sure anyone else content has not been used in my work. This applies to my work I have included on my portfolio as it includes my videography work and shall not contain any music etc which I haven't had copyrights or intellectual property rights too. This will apply to all my work on my portfolio. My vintage leather bag video will be appropriate for this legalisation rule as it shows a brand in my work, however as we got access to the company the client wanted us to create our own logo so we haven't taken any of there work which could get us done for Copyrights Act.
I will need to also adhere to laws and make nothing unsuitable for my website, as it will need to be regulated by W3C, which is the World Wide Web Consortium and regulates websites. They develop web standards therefore my work should be appropriate to be posted on my digital portfolio, if not it could get taken down. This will be appropriate in my portfolio for my work based around all of my work, this is because they regulate the websites itself.
BBFC is the British Board of film classification, this is where they put in age certificates on films and programs based on the language, violence, graphic scenes, drug abuse and much more. I will need to adhere to the rules of BBFC when I created my work for my music video and short film, these are both classed under there rules. Before putting my short filter. up Ardens Secret on my digital portfolio I will need to let my audience know that it has an age rating of 12, this will need to be on my portfolio as it allows our audience to know what is to expect and if there is anyone under the age of 12 shouldn't be watching it, it is also important for myself as I could get in trouble with the BBFC and W3C to not adhering to their laws.
The advertising standards Authority otherwise classed as ASA is the UKs independent advertising regulator. ASA make sure ads across the UK stick to the advertising codes which are on their website. I will need to adhere to these laws also on my digital portfolio, one of my pieces of work which I will need to apply the ASA rules are for my Vintage Leather bag company. This is important to be regulated as it is an advertising unit and shows the adverts I created in this unit to produce high quality ads and marketing to help gather a target audience, I made sure when creating the adverts there was no misleading advertisements and for ethical reasons having different ethnicities, genders etc on my ads to show that there was no discrimination.
I also need to adhere to the ASA laws in my radio show for ONE20 FM this is important to regulate as it has advertisements breaks which are important. I adhered to laws for example no harm of offence so I made sure that they do not cause harm or serious or a widespread offence. All my adverts were local based, therefore this makes it easier to regulate making sure all my adverts have a recognition of marketing communications.
For my portfolio I also need to adhere to the laws on PRS, this applies to all my work on my digital portfolio as this regulates music, so the royalties, copyrights and licensing. This applies to my music video Eclipse, short film Ardens Secret, Vintage leather bag advertisements and ON20 FM as I applied some source of music on all my work. I gathered all my music off websites such as Freesound.org and Bensound which has royalty free sounds therefore able to download by anyone without getting in trouble for Copyright
Finally, I addressed ethical issues through every piece of work on my portfolio. I ensured that all my models, actors, voice overs would show no discrimination towards anyone and for everyone to be treated equally throughout my productions. I have used all genders and different ethnicities to avoid any ethical issues. Although I have used stereotypes in my work I have not portrayed any in a bad way for example my music video as I wanted to set the target audience and see them as ideal self or ideal partner based on the same stereotypes.
